Gloria Allred's Worst Nightmare ? Transcript released but her ...

There will be a circus, but Allred will not be the ringmaster

Reports from inside the courtroom in Boston at which The Boston Globe is seeking access to Mitt Romney?s testimony in the divorce case of the founder of Staples indicate that the Judge will authorize the release of the transcript to The Globe, but will not lift the gag order on the parties to the divorce, including Gloria Allred?s Mormon-hating client, Maureen Sullivan.

Presumably that means that?the Mormon-hating client?s representative also cannot speak on behalf of her Mormon-hating client to put the ?context? on it.

It will be up to The Globe and other media to spin the transcript against Romney, which they certaily will do, but Allred will not be at the center of that circus.

Here?s the TMZ live feed:

7:10 AM PT ? The judge has agreed to release Mitt?s transcripts to the Boston Globe ? but Gloria?s client is not allowed to talk about the case.

7:02 AM PT ? Gloria is grasping at straws ? but it?s clear, the judge is not gonna cut her a break. Gloria vows to return to court after she files a motion.

6:55 AM PT ? It looks like Gloria is getting shut down because she never made the motion to ungag her client. The judge said the matter is not before the court.

6:53 AM PT ? We?ve made up our minds ? the judge is, in fact, hot.

6:51 AM PT ? The judge seems to be saying that Gloria didn?t make the proper motion to ungag her client.

6:38 AM PT ? It seems they have AGREED to release the transcripts.

6:37 AM PT ?Romney?s lawyer says the Gov. has no problem having his testimony made public.

It appears that the Judge didn?t lift the gag order because Allred had not actually filed a motion to lift the gag order. The only motion was by The Globe for access to the transcript.

So maybe Allred isn?t one of the best lawyers in America. But this never was about the law, it was about Allred seeking publicity, and The Globe doing Obama?s dirty work.

The Globe, of course, has not gone to court seeking access to Harvard?s federal filings, including documents signed by Elizabeth Warren, which might bring down Warren.

HBT: Valverde remains closer despite flops

Jose Valverde coughed up four runs in less than inning of work in Game 1 of the ALCS on Saturday night at Yankee Stadium and now has a brutal 8.79 career postseason ERA. But the Detroit coaching staff is apparently not ready to make a change.

According to beat writer Chris Iott of MLive.com, manager Jim Leyland said Sunday morning that Valverde won?t be used in Game 2 ?of the ALCS but is not done getting save opportunities this October.

?He doesn?t deserve to become a dart board,? said the veteran Tigers skipper. ?Jose Valverde is still a huge part of this team.?

Valverde registered a 3.78 ERA and 1.25 WHIP in 69 innings during the regular season, converting 35-of-40 save chances. The 34-year-old right-hander is scheduled to hit the free agent market next month.

Wacom Cintiq 24HD touch review: the pen-enabled display tacks on multi-touch gestures

Wacom Cintiq 24 HD touch review the highend pen display tacks on multitouch gestures and an improved panel

A few weeks ago, Wacom started shipping a new version of its Cintiq 24HD pen display for creative pros that first broke from cover last September. The appropriately named Cintiq 24HD touch carries virtually the same outer styling as the OG model. An ergonomic base still cradles the massive 24-inch screen and can be configured to your particular seating preference. On the inside, though, there's a host of changes. As the name suggests, the major difference between the two is the addition of multi-touch controls to the more recent offering. However, the added functionality does come with a pretty hefty price tag, as the Cintiq 24HD touch costs $1,100 more than its elder sibling. Are the additions of touch gestures and an improved display panel enough to justify forking over the extra coin, or will the less expensive option work just fine in a studio setting? Read on to find out as we tackle that very question.

Domestic Medium Hair - Tipper - Large - Adult - Male - Cat

I arrived at AWLMC from Lexington, VA. My former owner lost her job and is close to losing her house. She has lots of pets and needs to find new homes for some of us. She found me under a pile of rubble at a construction site with burnt paws. I am a handsome black and white tuxedo boy. My names come from the white ?tip? of my tail. I am friendly, but sometimes need to be encouraged to come out and explore my world. I don?t mind being held and I enjoy being petted. I have had 17 teeth pulled due to gum issues. I am doing really well and as you can tell I love to eat. Please take me home today! I was born in April 2007.

WASHINGTON (AP) ? Bruce Springsteen will be back campaigning for President Barack Obama.

The musician will join former President Bill Clinton at a Thursday rally in Parma, Ohio, two days after the second presidential debate. Obama will not attend the rally.

Springsteen also will appear at a campaign event Thursday in Ames, Iowa.

Springsteen campaigned for Obama in 2008, but these will be his first political appearances of the 2012 cycle. Clinton is a prominent campaigner for Obama.

Clinton and Springsteen's joint appearance in Ohio underscores the importance of the key swing state. Polls show Obama with a slight lead there over Mitt Romney, but the Republican presidential candidate is spending an increasing amount of time and resources in the state ahead of Election Day.

2 dogs found in St. Alban's Neighborhood

2 dogs found Friday in the St. Alban?s neighborhood.

These two dogs were found around 6 pm Friday wandering on O Henry Avenue in the St. Alban?s neighborhood. There are Davidson town pet tags, but no one at the town answered when called. One had a North Mecklenburg vet tag but the veterinarian wouldn?t give the address when called to find out where they live. The finder left them at the dog park so they don?t get hit in the road.? Recognize them?

'Gangnam Style' (and spoofs) hit 1.2 billion views

Gangnam Style, YouTube

By Sean Captain, Tech News Daily

Feel like you've been hearing "Gangnam Style" a lot lately? Say, 1.2 billion times? That's the number of online plays scored for either the original video, spoofs, mashups or other re-cuts of South Korean rapper PSY's surrealist hip-hop?ish video, according to analysis firm Visible Measures.

By now, "Gangnam Style" may have wiped out the memory of Carly Rae Jepsen's "Call Me Maybe," which, in all its permutations, has hit 998 million. That's despite Jepsen's song being out since March, whereas "Gangnam Style" first hit the Interwebs in July.

Only about a third of those "Gangnam Style" plays, 438 million, have been of the original video. The rest come from more than 600 user-created versions, according to Visible Measures.

?

That's a lot more than "Call Me Maybe" inspired ? probably because the crazy outfits, gyrations and dance ensembles of the Korean sensation permit more creative interpretations than did Jepsen's video, which mostly inspired incongruous lip syncing.

Some of the "Gangnam Style" YouTube clips earning a million or more views (sometimes far more) include "Gunman Style," "Gandalf Style," "Jewish Style," and "Klingon Style" (sung in actual Klingon). West Point cadets, a Cornell University flash mob and a mother-son team join in as well.

Videos span the range of technology, from Machinima choreography by manipulating characters in the game "The Elder Scrolls V: Skyrim" to?this lovely 8-bit recreation.

More ?from Tech News Daily:

The Internet sensation PSY rocks a jam-packed plaza by performing his hit song and dance "Gangnam Style," and the TODAY anchors join in to show off their very own horse-riding moves.

A-Rod benched by Yankees for Game 5 vs Orioles

NEW YORK (AP) ? Alex Rodriguez will start the New York Yankees' biggest game of the year on the bench.

After being pinch hit for in Games 3 and 4 against the Baltimore Orioles, the $275 million third baseman was removed from the starting lineup for Game 5 on Friday.

"I'm not happy and obviously disappointed," Rodriguez said. "Want to be in there in the worst way."

Eric Chavez was set to start at third base, while Game 3 star Raul Ibanez will be the designated hitter in the winner-take-all series finale.

"It is difficult. He has meant a lot to the organization, the game of baseball over the years," manager Joe Girardi said. "And he has been a very productive hitter. But he struggled against right-handers in the series, and Chavy has been good against right-handers all year long."

The 37-year-old Rodriguez is 2 for 16 (.125) with no RBIs in the series, going hitless in 12 at-bats against right-handed pitchers with nine strikeouts. He was 0 for 4 with three strikeouts in the opener against Jason Hammel, Baltimore's Game 5 starter.

Chavez hit .298 against righties during the regular season but is 0 for 4 against them in the playoffs.

Girardi contacted Rodriguez at about 1 p.m., before the 14-time All-Star arrived at Yankee Stadium, and informed him of the decision. Rodriguez took batting practice with the regular starters, not the reserves.

"It's never about Joe," Rodriguez said. "I always have to look in the mirror and do what I can do to do the best I can."

Since helping New York win the 2009 World Series, Rodriguez is 10 for 66 (.152) with no homers and six RBIs in postseason play. He hasn't homered in 84 at-bats since Sept. 14.

With the Yankees trailing 2-1 in the ninth inning of Game 3, Girardi sent up Ibanez to bat for A-Rod, and Ibanez hit a tying home run. Ibanez homered again in the 12th to give New York a 3-2 win.

Baltimore led 2-1 in the 13th inning in Game 4 when Chavez batted for Rodriguez and lined to third for the final out.

Is getting benched worse than getting pinch hit for?

"I'm not going to get into that," Rodriguez said. "I'm part of this team, and I'm ready to roll, and I'll be ready."

With the Yankees owing Rodriguez $114 million over the next five seasons, managing his decline could become a central issue for the team.

"I ain't worried about years ahead. Just let me worry about today," Girardi said. "The best relationships, the strongest relationships, are always relationships that go through some struggles. Relationships just aren't perfect. I mean, you put a husband and wife together where the relationship was just perfect without any struggles, and you're probably not living on this planet. So relationships go through that.

"So, I mean if things have to be, you know, built back up, we can do that. I have had to do that before. So I don't worry about that."

Fifth on the career list with 647 home runs ? 115 behind Barry Bonds' record ? Rodriguez has been slowed by five trips to the disabled list in five seasons: for a strained quadriceps (2008), hip surgery (2009), a strained calf (2010), knee surgery (2011) and a broken hand, sustained July 24 when hit by a pitch from Seattle's Felix Hernandez.

Before the start of spring training in 2009, he admitting using performance-enhancing drugs while he was with the Texas Rangers from 2001-03.

As for the rest of the Yankees' lineup, Derek Jeter was back at shortstop after being moved to DH for a game because of a sore left foot. Jeter led off, followed by left fielder Ichiro Suzuki, second baseman Robinson Cano, first baseman Mark Teixeira, Ibanez, right fielder Nick Swisher, center fielder Curtis Granderson, catcher Russell Martin and Chavez.

Yankees ace CC Sabathia was on the mound. He led the Yankees to a 7-2 win in the opener.

Girardi decided against benching Granderson, who is 1 for 16 (.063) with nine strikeouts in the series. He did not want to start Brett Gardner, who has been limited to three at-bats since mid-April because of an elbow injury that required surgery.

"If Grandy stays in his zone, he will be fine," Girardi said. "That's the big thing he has to concentrate on."

Not a Martyr: 25 Stunning & Extraordinary Toddler-Wearing Photos ...

top3 1024x1024 Not a Martyr: Stunning & Extraordinary Toddlerwearing Images From Around The WorldAs we draw to a close on International Babywearing Week, I thought what better way to celebrate than to make a call out to all of our awesome readers and fellow Babble bloggers who are active baby and toddler wearers?

I was going to make this a response?piece?to this silly little article that was written on The Stir, but the more submissions I received and quotes sent in and the conversations I had with the mamas who were sending their pictures in?well, I was?inspired and delighted. The annoyance of that silly little article sort of just melted away. These pictures and these stories, speak for themselves.

I?m pretty sure that our ancestors the world over who wore their children?they didn?t consider themselves martyrs. They were getting shit done and loving their kids. Not much more needs to be said. There?s enough heavy and heated debates going on betwixt mothers.

Let?s end the week by celebrating in all of the vast and incredible ways we choose to mother.

Enjoy and Happy Toddlerwearing!

We travel A LOT with my partner frequently touring as a musician. There isn't (as in rarely if ever) always room for the stroller on top of the stand-up bass and our luggage and other gear. Aside from all of that? I ENJOY wearing my babies and toddlers. I can't do it all the time, as I have a bad back, but I do it when I can and when I want.

"Oh boy am I thankful for babywearing. I don?t exactly know how parenting two this close in age would be possible otherwise. I am so thankful I live in an age where quality and ergonomic carriers that don?t kill your back like the Ergo exist. I often have older women raise their brows and say to me ?Well. We didn?t have those in when I was having babies? and I normally smile and say something like ?Oh? because I am socially weird. "I love that I am able to wear my toddler. I hear so many people say that they loved wearing their baby, but stopped once baby became mobile and transitioned into toddlerhood. Adele loves to be worn, and at 20 months, I still wear her on a daily basis. Toddlers are busy little people, with an agenda all their own. I love that wearing Adele brings her back to mama for some time to reconnect and continue to strengthen the bond that has been building over the last 20 months. I love allowing my toddler the chance to learn while being worn, experiencing the world from mama's back."

DesJarlais endorsement vanishes from Romney site

Scott DesJarlais, his Republican opponent in the race, for a transcript of a recorded telephone conversation that appears to recount how the freshman congressman urged his pregnant mistress to get an abortion more than a decade ago. (AP) ? An endorsement from a Tennessee congressman who in a recorded phone conversation urged a mistress to get an abortion has vanished from Republican presidential candidate Mitt Romney's website.

Freshman Rep. Scott DesJarlais, who opposes abortion rights, told a Nashville talk radio show Thursday that while there were many difficult elements to his 2001 divorce, "there was no pregnancy, and no abortion."

But DesJarlais did not dispute the transcript of a recorded phone conversation in which he urges the woman to terminate a pregnancy more than a decade ago.

"You told me you'd have an abortion, and now we're getting too far along without one," DesJarlais is quoted as saying in the transcript. "If we need to go to Atlanta, or whatever, to get this solved and get it over with so we can get on with our lives, then let's do it."

DesJarlais' endorsement of Romney still appears on the congressman's website, but a link to the presidential campaign site returns an "access denied" message.

The Romney campaign did not immediately comment.

The revelations did not prevent DesJarlais from presiding over a quick pro forma session of the House in Washington on Friday. The congressman had cited that responsibility in declining to participate in a debate with his Democratic opponent, state Sen. Eric Stewart.

While the Tennessee Republican Party appears to be standing behind DesJarlais, other GOP leaders in the state like Gov. Bill Haslam and Sen. Lamar Alexander have sought to avoid being drawn in.

Haslam said he wanted to speak with DesJarlais before voicing an opinion, but didn't say when that conversation would take place. "I probably will speak to him at some point in time," he said.

Alexander said it wasn't his practice to "go around telling people what to do about issues like that.

"That's between the congressman and the voters in his district and his opponent," he said. "I know the voters of his district very well, and they're perfectly capable of making their own minds up."

DesJarlais in the radio interview blamed "a disgruntled, defeated ex-congressman, a vindictive ex-wife, and a desperate Democratic candidate" for dredging up details from his past.

The DesJarlais campaign has dismissed the details as "old news" that emerged in the last election cycle. But while the 2010 campaign did feature allegations raised during his divorce that he intimidated his ex-wife with a gun ? and in one instance put a gun in his mouth for three hours ? the abortion element was not public knowledge until this week.

DesJarlais said in the radio interview that he has remarried and has enjoyed a "near perfect" marriage for the last decade.

"I would hope that when the voters judge me, they judge me on the marriage I have now," he said.

NBA 2K13 (PC, PS3, PSP, Xbox 360, Wii)

The nascent stages of the 2012-2013 NBA season coincide with the inevitable video game tie-in with the release of 2K Sports' NBA 2K13 (also available as a Dynasty Edition). Featuring outstanding ball-handling and shooting controls, and the presentation sensibilities of executive producer Jay-Z, NBA 2K13 feels fresh?something you wouldn't expect from a sports game that lacks competition (EA Sports' NBA Live is M.I.A. for the third consecutive year). Simply put, NBA 2K13 is the best NBA game I've ever played.

Blow the Whistle
Jay-Z's touch is evident as soon as you insert the disc into the console. The attract mode features the rapper-mogul's performances spliced into in-game footage. The combination isn't as jarring as it would initially appear since Jigga is now a partial owner of the freshly relocated Brooklyn (formerly New Jersey) Nets. Fortunately, Jay-Z steps back a bit on the soundtrack?he has five songs, but spreads the love with the likes of Nas' "It Ain't Hard to Tell," Mobb Deep's "Shook Ones Pt. II," U2's "Elevation," Coldplay's "Viva La Vida," and Roy Ayers " We Live in Brooklyn, Baby." It's one of the few sports games with a soundtrack that doesn't grate on the ears.

The rebranded "My Player" mode, now known as "My Career," is essentially a sports role-playing game in which you live the life of a single created player. You can sign endorsement deals, haggle contracts, select clothing, create sneakers, choose pre-game rituals, and more. If you're a sports gamer who has always wanted to live the life of a pro athlete, this is your mode. Its depth is shockingly deep.

Lace Up the Sneaks
NBA 2K13's gameplay is just as deep?in fact, there are so many offensive and defensive moves that you may want to play with an open instruction booklet. You'll need it for the new Control Stick that gives you incredible control over ball handling and shooting. Using it in conjunction with other buttons lets you pull off dunks, crossovers, lay ups, hop steps, runners, pump fakes, and many other moves. There are defensive moves aplenty, too; flops, wrap fouls, rebounds, lunges, and numerous other moves are available. The wide range of options creates a game that looks like one pulled directly from broadcast TV. If you understand basketball's intricacies, such as mastering and defending the pick-and-roll, you'll do well.

The new Signature Skills further individualize the hundreds of in-game athletes by giving them specific perks that replicate the players they're based on. Kobe Bryant, for example, possesses the "Closer" Signature Skill, which increases his stamina, and the likelihood of making free throws and moving shots. Andre Iguodala is a "Lockdown Defender" who automatically neutralizes most offensive Signature Skills. Role-players have Signature Skills, too, but superstars will have many, often on both the offensive and defensive ends. These skills can help you decide which players are best in particularly situations, and thus help your coaching.

NBA 2K13 features not just the 30 regular teams, but classic teams such as the Bad Boy Pistons and Showtime Lakers. To celebrate the 20th anniversary of the Dream Team?the first U.S. Olympic Men's Basketball team to feature active NBA players?NBA 2K13 features the original classic team (Jordan, Ewing, Bird) and the 2012 Dream Team (Kobe Bryant, LeBron James, Kevin Durant).

One knock: the menu systems need an overhaul. Some, like the substitution screen, are busy and may prove confusing until you get the swing of things.

Digging Deep
Playing online is surprisingly smooth. I played several matches and didn't encounter much lag. That said, there are some truly hardcore players out there, so make sure to bring your A-game.

The Xbox 360 version utilizes Microsoft's Kinect peripheral to let gamers call plays by, well, calling plays. Speak a specific play (like "Clear Out" or "Pick and Roll") and your squad will follow our command. You can also use it to sub players. I was surprised with how well it worked. In fact, you need to watch your language after what you perceive to be a bad call?you may be called for a tech.

The Highlight Reel
The graphics deftly recreate the NBA experience. The athlete's character models are well-designed for the most part (they tug at shorts when tired, wipe sweat away), but they suffer from cold, dead fish eyes that ruin some of the realism. Plus, non-athletes (cheerleaders and fans) look as though they were pulled from an entirely different game?they feature incredibly low detail and bland colors. It's nearly as egregious as the Morrigan sprite in Capcom vs. SNK 2.

That said, the ballers' movement?be it running, rebounding, or shooting?is outstanding. There are tons of animations and they're all smooth, keeping the controls sharp. Players attack the basket and ball in a variety of ways and perform signature moves that look absolutely gorgeous.

The excellent four-person commentary from Kevin Harlan, Clark Kellogg, Steve Kerr, and Doris Burke gives NBA 2K13 its soul. The play-calling is spot on?it doesn't lag behind the action?and there's plenty of ancillary commentary (such as the rather in-depth conversations about the Nets move to Brooklyn's Barclays Center) that keeps the audio fresh.

Winning the Ring
It's easy to say that NBA 2K13 is the best pro hoops on the market because there's no other competition, but 2K Sports' latest basketball title does the NBA right while keeping flaws to the minimum. Some will naturally decry it as nothing more than promotion for Jay-Z, the Brooklyn Nets, and Barclays Center, but if you can overlook that you'll find one best basketball video games ever made.

This Is Not a Flower [Image Cache]

This isn't a romantic pink rose, nor any other kind of flower you can name. In fact, it's a wonderfully delicate crystalline bloom of germanium sulphide with petals that are just 20 nanometers thick. More »

Anti-Piracy Group Already Protesting That UK's Anti-Piracy Law ...

from the history-lessons dept

History teaches us that representatives of copyright holders will complain about any new development in information or communication technology and try to stop or limit its use. Well, it is no surprise then that, over in the UK, the Federation Against Software Theft (FAST) is claiming that existing, already far-reaching copyright enforcement measures in the not-yet implemented Digital Economy Act (DEA) will be rendered useless when the new 4G mobile phone network rolls out. The 4G mobile phone networks has been anticipated with much fanfare and will provide mobile broadband speeds, which are many times faster than the 3G network we have become used to in the UK. According to FAST, mobile users and operators now also need to fall within the scope of the controversial DEA.

In a recent Techdirt post about the DEA, Glyn Moody finished with the sentence "The longer the great Digital Economy Act farce drags on, the more absurd it becomes from every viewpoint." With FAST's claims, the debate is set to continue, and yes, it will become more absurd. Here's a short recap of DEA before we see how history repeats itself when its lessons are ignored:

  • The DEA was hastily passed at the end of the last UK Parliament's term to "combat piracy", or whichever rhetoric was used this time.
  • The act initially proposed to block websites and disconnect repeat infringers of copyright in a graduated response type system, or otherwise limit internet access. Customers may also be taken to court because ISP's would be obliged to disclose personal information of their customers.
  • The scope is limited to the largest ISP's in the UK, which covers about 93% of its citizens.
  • The implementation of the DEA has been delayed due to heavy criticism. Some of these ISP's went to court about the hefty costs which need to be made to enforce copyrights online.
  • Some provisions, such as the blocking of websites at the ISP level, have since been scrapped. This was not met with much resistance from rights holders, as they already had their Supreme Court precedent set with the blocking of the Pirate Bay.
  • More specifics about this piece of legislation can be found around the internet, but as a final point it must be mentioned that -- surprise surprise -- the whole impact assessment of the act was based on highly inflated and controversial figures with bogus methodologies, provided by private stakeholders.

Let's dive into the claims of this most recent attempt to attack the technology as legacy players try to stay relevant. Of course, every time they do this, they discover that they're on the wrong side of innovation. Again. And, all too often, the goals of these groups run entirely contrary to the real wishes of those they claim to represent. Julian Heathcote Hobbins, General Council at FAST, states the following:

The DEA has the potential to be a valuable piece of legislation in the fight against illicit peer-to-peer copyright infringement and a significant development for rights holders as an educational programme. However, the DEA must remain timely. The issue is that by the time the DEA is finally implemented, technology could have moved on so far making the Act ineffective in helping to deal with those using 4G networks to share files. In its current form the DEA is not sufficiently flexible in scope to account for advances in technology.
Another representative, Jonathan Cornthwaite, a lawyer in London and member of FAST's Legal Advisory Group, then goes on to state:
[...] As we are now witnessing, technology does not stand still and gaps are appearing in the DEA as the use of mobile devices accelerates. Unless this situation can be remedied, it may be of less assistance, leaving rights holders with a watered down remedy.
It is fascinating to see these representatives finally realizing that regulation will not be able to keep apace with technological developments, where innovation happens at internet speed. They are right in stating that legislation must be flexible to stay timely and to move with technological and societal advances, which are indeed moving at an unprecedented pace.

However, they fail to think through that it may not be the enforcement side, but actually that the copyright system lacks social legitimacy because it is out of date and out of touch with how we now live in media. The approach chosen by these representatives leans more towards a permission innovation society as identified by Mike in a recent post, where former Register of Copyrights, Ralph Oman, expressed that he feels any new technology should have to apply to Congress for approval, before it is allowed to exist. Instead, we should follow the sensible part of Mr. Heathcote Hobbins and Mr. Cornthwaite's analysis and make the underlying copyright system timely and flexible so it takes into account technical reality, which, indeed, does not stand still.

A group of UK mobile operators have branded their 4G service "Everything, Everywhere" (EE), indicating they understand what consumers want: all media available at any time in any place. This does not directly mean consumers want media for free. Most are willing to pay for access, especially when the service purchased offers them the ability to use works without undue restrictions. A line can be drawn as to which uses are permissible and which are not. However, if restrictions inhibit normal media usage as consumers expect it, and penalties include disconnection, throttling or otherwise limiting the promise of the super-fast paced mobile internet experience, copyright will further lose social legitimacy and work-arounds will be found.

France's graduated response scheme -- HADOPI -- has already failed miserably, thereby proving the critics right that such a scheme is not workable nor desirable with regards to media sharing on the internet. Why then push for a very similar DEA anyway? Give it another go in a new country, hoping for different results? Apply it to new technology and hope the criticism will go away? To quote Einstein: "Insanity is doing the same thing, over and over again, but expecting different results."

The Magazine, by passionate technologists, for passionate technologists, now available in Newsstand

The Magazine is a new endeavor by Marco Arment, the creator of Instapaper and host of Build & Analyze, with no greater or lesser goal than to do an iOS Newsstand periodical the way it was meant to be done. In a market all too littered by massive, unwieldy Adobe InDesign exports, shackled to old-world sales and marketing models, The Magazine's premise comes off as audacious -- 4 articles every two weeks, written by passionate technologists for passionate technologists. Here's how Arment describes it in his forward/declaration of intent:

I?ve always loved technology, and I especially love the recent focus on mobile phones, tablets, and truly great personal computers. These interests also increasingly include other fields, such as photography, publishing, and music, affected heavily by technology.

This is what The Magazine is about.

Arment is also taking a page, almost literally, from Instapaper's playbook. Eschewing the static PNG files and anachronistic layouts of traditional magazines, he's simply, beautifully, cleanly, presenting The Magazine's content in as enjoyably readable a format a possible. Controls are likewise minimal. From the table of contents you can switch between dark and light mode, increase or decrease the type size, or swipe to delete content (a small trashcan will appear in the colored issue number/data bar to confirm).

From an individual article's page, you can share content via Mail, Message, Twitter, or Facebook, or send a copy to the clipboard or to Instapaper. Links are easy to see and if you tap on one, the article lifts up to show you a preview of the linked content. If you tap a link in the preview, you're carousel'ed out of The Magazine and the web page is served up in Safari.

The reading controls, however, are only available on the table of contents screen, so you can't change type size or toggle dark/light modes while inside an article, which also means you can't preview type-size changes without flipping back and forth. The share sheet is available on the article pages, but it's anchored to the top, so if you only decide you want to share an article by the time you finish reading it, you have to scroll all the way back to the top. Some sort of persistent controls (the way the issue number and date persist on the table of content), or even a set reveal-on-touch controls, would feel better.

Scrolling in articles is fast and fluid, and both button and gesture-based navigation options are available. From the table of contents screen, tap a article to go to that article, and tap the contents button to go back to the table of contents. You can also swipe to push the table of contents aside and reveal an article beneath it (the first article if you haven't begun reading yet, otherwise the last article you were reading). You can also swipe to pull the table of contents back into place so you can choose another article. Unfortunately, you can't swipe the other way to navigate to the next article. That's something I keep instinctively wanting to do, so hopefully it gets added in a future release.

In addition to Arment's forward, the first issue of The Magazine includes essays by Guy English, Jason Snell, Alex Payne, and Michael Lopp. English takes a look at the [Daring] Fireball Format of link blogs and their rise in popularity, Snell tackles the schism between geeks who do and don't love sports, Alex Payne laments on the people behind technology and how sometimes we get it wrong, and Lopp explores leadership and the dynamics between stability and volatility.

Most magazines aren't really in the content business. They're in the advertising and marketing business, selling our attention and our mailing addresses, with the content serving as a kiss and a cookie to keep us happily flipping page and subscribed. That's not always bad, and some really terrific magazines have been funded using that model. But The Magazine looks to be in the actual content business -- you read what you pay for.

With The Magazine, Arment has stripped the traditional format, model, and expectations of the magazine down to its essence, to the barest possible elements it needs to exist as a magazine -- a determined publisher, talented writers, and solid content -- and is hoping that in doing so, it flourishes.

I hope so as well. I hope it gives voice and exposure to a wide array of technologists who take the opportunity to raise the bar and the stakes of technology writing. And I hope it provides an oasis to readers hungry for just that. That may sound like a lot of pressure to put on a new type of publication on the day of its very first issue, but it seems like not an ounce less than Arment himself is placing upon it. And that's a stupendous thing.

The first issue of The Magazine, with free 7-day trial, is available now. Subscriptions cost $1.99 a month (which should include 2 issues given the current publishing schedule). Give it a read.

Note: There's currently a bug that prevents you from subscribing on multiple iOS devices. According to Arment, a fix is on its way.
