    Keep police business off Facebook, NYPD tells cops - Technology ...

    The New York Police Department has begun policing how its officers use Facebook, Twitter and other social media.

    An internal order made public on Thursday advises members of the nation's largest police department to be careful with what they reveal online ? even urging them not to disclose that they're on the force.

    Officers "are to exercise good judgment and demonstrate professionalism expected of them while performing their official duties," the memo says. It also warns that "personal social media sites may be used against them to undermine the credibility of the department, interfere with official police business, compromise ongoing investigations and affect their employment status."

    The guidelines bar officers from posting photos of themselves in uniform ? with the exception of those taken at promotion or awards ceremonies ? unless they have permission from the department. Officers could face discipline if they don't comply.

    Police officials said the policy has been in the works for about two years, and arose out of concern that police officers' online postings could embarrass the NYPD or be misinterpreted as official police policy. The department punished more than a dozen officers after they made degrading remarks about revelers at the West Indian Day Parade in 2011.

    "We believe these guidelines are reasonable and make sense," Police Commissioner Raymond Kelly said Thursday.

    The Patrolmen's Benevolent Association, which represents 23,000 police officers, declined comment. In the past, the union has cautioned its members about what they post and who they interact with on the Internet.

    The NYPD edict prohibits the posting on personal websites of crime scene photos or witness statements. It also bars officers from using social media to contact witnesses, crime victims or lawyers involved in pending cases, or to contact minors who aren't part of their families.

    "Such communications may be deemed inappropriate or unethical and may jeopardize an ongoing investigation," it says.

    The adoption of guidelines was first reported in the Daily News.

    Fiat CEO probed for violation of workers' rights

    MILAN (Reuters) - Fiat's CEO Sergio Marchionne is being investigated in Italy over allegations of violation of labor rights in a long-running dispute at a factory near Naples, the automaker said on Friday.

    Fiat, Italy's biggest private sector employer, said Marchionne and another group manager were notified by the public prosecutor of Nola of a preliminary investigation on Friday.

    Fiat said the prosecutor's move was "the umpteenth expression of an unprecedented judiciary offensive directed by (trade union) FIOM against Fiat, for more than two years".

    The dispute stems from a Rome appeals court ruling last October that Fiat must take back 19 laid-off employees who were members of FIOM and had filed a complaint alleging discrimination.

    Fiat, which controls U.S. carmaker Chrysler, has denied several times any wrongdoing.

    Back in February, Marchionne said the dispute at the factory had been resolved, taking the heat out of the controversial issue in the country's election campaign.

    Politicians and labor leaders criticized Fiat ahead of the February vote for trying to lay off the 19 workers at the factory, in a country mired in recession.

    Yeloworld announces Yeloworld 2.2 for iOS. Yeloworld is a startup launched in January 2013 with the objective to end the rip-off that mobile users endure from mobile network operators whenever they make international calls or are traveling abroad and roaming - and as a result do to calling what WhatsApp did to SMS.

    In simpler terms, Yeloworld is an app for iOS (iPhone, iPad, iPod touch) and Android phones/tablets that allows users to make very cheap phone calls to any mobile or landline numbers, anywhere in the world, and save a lot of money on international calls.

    Yeloworld allows users to call regular phone numbers. This means that the receiving party doesn't need to own a smartphone, install any app whatsoever or even be online to receive the call, just a regular telephone. Yeloworld allows everyone to call anyone, anywhere, on their "normal" phone (cellphone or fixed landline), regardless of where they are and what type of phone they have.

    The apps for iPhone, iPad, iPod touch and Android are the first set of apps, but to take Yeloworld to the next level, the company now needs funding to rollout more apps to more platforms (BlackBerry, Windows Mobile and even Web Apps), add more features (SMS and more) and ultimately create new jobs.

    Yeloworld has started a crowdfunding campaign to help them reach their potential to help millions of smartphone users around the world save billions of dollars on their phone bills and make a significant impact in the way people communicate in a modern, digitally borderless world.

    Business, labor close deal for immigration reform

    WASHINGTON (AP) ? Big business and major labor unions appeared ready Friday to end a fight over a new low-skilled worker program that had threatened to upend negotiations on a sweeping immigration bill in the Senate providing a pathway to citizenship for 11 million immigrants already in the U.S.

    Sen. Chuck Schumer, D-N.Y., who?s been brokering talks between the AFL-CIO and the Chamber of Commerce, said in a statement that negotiators are ?very close, closer than we have ever been, and we are very optimistic.? He said there were still a few issues remaining.

    The talks stalled late last week amid a dispute over wages for workers in the new program, and senators left town for a two-week recess with the issue in limbo. Finger-pointing erupted between the AFL-CIO and the chamber, with each side accusing the other of trying to sink immigration reform, leaving prospects for a resolution unclear.

    But talks resumed this week, and now officials from both sides indicate the wage issue has been largely resolved. An agreement would likely clear the way for a bipartisan group of senators to unveil legislation the week of April 8 to dramatically overhaul the U.S. immigration system, strengthening the border and cracking down on employers as well as remaking the legal immigration system while providing a path to citizenship for 11 million undocumented immigrants already in the U.S.

    ?We?re feeling very optimistic on immigration: Aspiring Americans will receive the road map to citizenship they deserve and we can modernize `future flow? without reducing wages for any local workers, regardless of what papers they carry,? AFL-CIO spokesman Jeff Hauser said in a statement. ?Future flow? refers to future arrivals of legal immigrants.

    Under the emerging agreement, a new ?W? visa program would bring tens of thousands lower-skilled workers a year to the country. The program would be capped at 200,000 a year, but the number of visas would fluctuate, depending on unemployment rates, job openings, employer demand and data collected by a new federal bureau pushed by the labor movement as an objective monitor of the market.

    The workers would be able to change jobs and could seek permanent residency. Under current temporary worker programs, workers can?t move from employer to employer and have no path to permanent U.S. residence and citizenship.

    The new visas would cover dozens of professions such as long-term care workers and hotel and hospitality employees. Currently there?s no good way for employers to bring many such workers to the U.S.; an existing visa program for low-wage nonagricultural workers is capped at 66,000 per year and is supposed to apply only to seasonal or temporary jobs.

    The Chamber of Commerce said workers would get paid actual wages paid to American workers or the prevailing wages for the industry they?re working in, whichever is higher. The Labor Department determines prevailing wage based on rates prevailing in specific localities, so that it would vary from city to city.

    The labor organization had accused the chamber of trying to pay workers in the new program poverty-level wages, something the chamber disputed.

    There was also disagreement about how to deal with certain higher-skilled construction jobs, such as electricians and welders, and it appears those will be excluded from the deal, said Geoff Burr, vice president of federal affairs at Associated Builders and Contractors. Burr said his group opposes such an exclusion because, even though unemployment in the construction industry is high right now, at times when it is low there can be labor shortages in high-skilled trades and contractors want to be able to bring in foreign workers. But unions pressed for the exclusion, Burr said.

    The low-skilled worker issue had loomed for weeks as perhaps the toughest matter to settle in monthslong closed-door talks on immigration among Schumer and seven other senators, including Republicans John McCain of Arizona and Marco Rubio of Florida. The issue helped sink the last major attempt at immigration reform in 2007, when the legislation foundered on the Senate floor after an amendment was added to end a temporary worker program after five years, threatening a key priority of the business community.

    The amendment passed by just one vote, 49-48. President Barack Obama, a senator at the time, joined in the narrow majority voting to end the program after five years.

    Finals Preview? Heat visit Spurs on Sunday

    By the time the Miami Heat get on their plane to come home late Sunday night, they could have a stranglehold on the race to finish with the NBA's best record.

    All they have to do is win at San Antonio. That, of course, is no easy task.

    The Heat (57-15) take a two-game lead in the NBA standings over the Spurs (55-17) into their matchup on Sunday. A win would essentially provide Miami a four-game cushion with nine remaining, given that the Heat also would control any potential head-to-head tiebreaker with San Antonio.

    If the Heat lose, the race for home-court advantage throughout the entirety of the playoffs could turn into a frantic, down-to-the-wire deal.

    "It's always good to play the best, to play against the best," LeBron James said. "It'll be an opportunity for us. We just want to get better, man. The game Sunday doesn't define our season or how we go from there. We just want to continue to move forward and get better throughout the rest of the season."

    Miami has won 28 of its last 29 games overall, getting back on the winning track at New Orleans on Friday, two days after Chicago snapped a 27-game Heat winning streak. But San Antonio has won 28 of its last 30 games at home, and facing the Spurs on the road is traditionally a painful expedition for many members of the Heat ? as it tends to be for everyone else in the NBA.

    Dwyane Wade is 1-4 at San Antonio, sitting out three other Heat losses there during his career. Chris Bosh is 1-7. James is 3-7. Shane Battier ? a longtime player in the Western Conference ? has enjoyed eight wins from the visitors' side when facing the Spurs, and also been on the losing end 16 times there.

    "It's obviously a very, very, very good team," Wade said. "Very tough place to play, so I think our mentality and how we approach the game is going to be important. You just try to go out there and compete, as we do every night, try to get a great road win. It's not going to be easy but that's kind of what we enjoy."

    The only other meeting between the clubs this season was Nov. 29 in Miami, a strange game in that Spurs coach Gregg Popovich ? citing a desire to rest his best players at the end of a long road trip ? sent Tim Duncan, Manu Ginobili, Tony Parker and Danny Green home before the game.

    With guys like Patty Mills, Nando De Colo and Matt Bonner filling out the starting lineup ? they've combined to make four other starts this season ? the Spurs almost beat the Heat anyway, leading by five with 2:13 left before getting outscored 12-2 in a wild Miami finish that gave the Heat a 105-100 win.

    Ginobili played just under three minutes in Friday night's win over the Los Angeles Clippers because of a hamstring issue, and Popovich indicated he probably won't be ready to face the Heat.

    "I don't think he can play," Popovich said.

    The Spurs have won six of their last seven games. Of those six wins, only one came by double figures, an 11-point victory over Golden State. The average margin of the other five wins in that span, over Dallas, Cleveland, Utah, Denver and Clippers was 3.4 points, and the only loss was a one-pointer at Houston.

    "It's great challenges, good preparation for us for the playoffs," Parker said. "Denver is a great team, Clippers a great team and now we've got Miami. They're the best in the league. They went on the unbelievable run and it's going to be another great game."

    This game could have been one of the most-watched among regular-season games in years if Miami had not lost in Chicago on Wednesday. Had the Heat won there and won in New Orleans, as they did on Friday, they would have been going for their 30th straight win on this trip to San Antonio in what will be touted either way as a potential NBA Finals preview.

    "I just want you to know the Heat are going to be just fine," said President Barack Obama, a noted Bulls fan during a stop in Miami on Friday. "They're going to be OK. They are playing basketball the right way."

    The Heat streak is gone, but standings-wise, it's still a big deal.

    "Very good team, obviously the defending champs," Duncan said. "I think they won 62 in a row or something like that. It'll be a great game. I know our crowd will be excited and we'll be excited to continue our homestand."

    Heat coach Erik Spoelstra has said everyone on his roster should be considered day-to-day for the remainder of the regular season. This is when teams like to ensure that players get some rest wherever they can.

    And the No. 1 seed in the Eastern Conference is already clinched, meaning all that's really left on the Heat to-do list before the opening round of the playoffs is finish atop the NBA's regular-season standings.

    "The mindset will be, first and foremost, playing our game and making sure that we establish our identity," Spoelstra said. "That's the whole thing with us. When we do that and play the way we're capable, results take care of themselves.

    "We don't want to get caught up in too much of the results. We have a big goal in mind. That's the No. 1 goal and that's the only goal we've talked about."

    Getting under the shell of the turtle genome

    The genome of the western painted turtle (Chrysemys picta bellii) one of the most widespread, abundant and well-studied turtles in the world, is published this week in Genome Biology. The data show that, like turtles themselves, the rate of genome evolution is extremely slow; turtle genomes evolve at a rate that is about a third that of the human genome and a fifth that of the python, the fastest lineage analyzed.

    As a group, turtles are long-lived, can withstand low temperatures including freezing solid, can survive for long periods with no oxygen, and their sex is usually determined by the temperature at which their eggs develop rather than genetically. The painted turtle is most anoxia-tolerant vertebrate and can survive up to four months under water depending on the temperature. Turtles and tortoises are also the most endangered major vertebrate group on earth, with half of all species listed as endangered. This is the first turtle, and only the second non-avian reptile genome to be sequenced, and the analysis reveals some interesting insights about these bizarre features and adaptations, many of which are only known in turtles.

    The western painted turtle is a freshwater species, and the most widespread turtle native to North America. Bradley Shaffer and colleagues place the western painted turtle genome into a comparative evolutionary context, showing that turtles are more closely related to birds and crocodilians than to any other vertebrates. They also find 19 genes in the brain and 23 in the heart whose expression is increased in low oxygen conditions ? including one whose expression changes nearly 130 fold. Further experiments on turtle hatchlings indicated that common microRNA was involved in freeze tolerance adaptation.

    This work consistently indicates that common vertebrate regulatory networks, some of which have analogs in human diseases, are often involved in the western painted turtle achieving its extraordinary physiological capacities. The authors argue that the painted turtle may offer important insights into the management of a number of human health disorders, particularly those involved with anoxia and hypothermia.

    Analysis: NKorea threat may be more bark than bite

    SEOUL, South Korea (AP) ? Across North Korea, soldiers are gearing up for battle and shrouding their jeeps and vans with camouflage netting. Newly painted signboards and posters call for "death to the U.S. imperialists" and urge the people to fight with "arms, not words."

    But even as North Korean leader Kim Jong Un is issuing midnight battle cries to his generals to ready their rockets, he and his million-man army know full well that a successful missile strike on U.S. targets would be suicide for the outnumbered, out-powered North Korean regime.

    Despite the hastening drumbeat of warfare, none of the key players in the region wants or expects another Korean War ? not even the North Koreans.

    But by seemingly bringing the region to the very brink of conflict with threats and provocations, Pyongyang is aiming to draw attention to the tenuousness of the armistice designed to maintain peace on the Korean Peninsula, a truce North Korea recently announced it would no longer honor as it warned that war could break out at any time.

    It's all part of a plan to force Washington to the negotiating table, pressure the new president in Seoul to change policy on North Korea, and build unity at home ? without triggering a full-blown war if all goes well.

    In July, it will be 60 years since North Korea and China signed an armistice with the U.S. and the United Nations to bring an end to three years of fighting that cost millions of lives. The designated Demilitarized Zone has evolved into the most heavily guarded border in the world.

    It was never intended to be a permanent border. But six decades later, North and South remain divided, with Pyongyang feeling abandoned by the South Koreans in the quest for reunification and threatened by the Americans.

    In that time, South Korea has blossomed from a poor, agrarian nation of peasants into the world's 15th largest economy while North Korea is struggling to find a way out of a Cold War chasm that has left it with a per capita income on par with sub-Saharan Africa.

    The Chinese troops who fought alongside the North Koreans have long since left. But 28,500 American troops are still stationed in South Korea and 50,000 more are in nearby Japan. For weeks, the U.S. and South Korea have been showing off their military might with a series of joint exercises that Pyongyang sees a rehearsal for invasion.

    On Thursday, the U.S. military confirmed that those drills included two nuclear-capable B-2 stealth bombers that can unload the U.S. Air Force's largest conventional bomb ? a 30,000-pound super bunker buster ? powerful enough to destroy North Korea's web of underground military tunnels.

    It was a flexing of military muscle by Washington, perhaps aimed not only at Pyongyang but at Beijing as well.

    In Pyongyang, Kim Jong Un reacted swiftly, calling an emergency meeting of army generals and ordering them to be prepared to strike if the U.S. actions continue. A photo distributed by North Korea's official Korean Central News Agency showed Kim in a military operations room with maps detailing a "strike plan" behind him in a very public show of supposedly sensitive military strategy.

    North Korea cites the U.S. military threat as a key reason behind its need to build nuclear weapons, and has poured a huge chunk of its small national budget into defense, science and technology. In December, scientists launched a satellite into space on the back of a long-range rocket using technology that could easily be converted for missiles; in February, they tested an underground nuclear device as part of a mission to build a bomb they can load on a missile capable of reaching the U.S.

    However, what North Korea really wants is legitimacy in the eyes of the U.S. ? and a peace treaty. Pyongyang wants U.S. troops off Korean soil, and the bombs and rockets are more of an expensive, dangerous safety blanket than real firepower. They are the only real playing card North Korea has left, and the bait they hope will bring the Americans to the negotiating table.

    Narushige Michishita, director of the Security and International Studies Program at Japan's National Graduate Institute for Policy Studies, isn't convinced North Korea is capable of attacking Guam, Hawaii or the U.S. mainland. He says Pyongyang hasn't successfully tested an intercontinental ballistic missile.

    But its medium-range Rodong missiles, with a range of about 800 miles (1,300 kilometers), are "operational and credible" and could reach U.S. bases in Japan, he says.

    More likely than such a strike, however, is a smaller-scale incident, perhaps off the Koreas' western coast, that would not provoke the Americans to unleash their considerable firepower. For years, the waters off the west coast have been a battleground for naval skirmishes between the two Koreas because the North has never recognized the maritime border drawn unilaterally by the U.N.

    As threatening as Kim's call to arms may sound, its main target audience may be the masses at home in North Korea.

    For months, the masterminds of North Korean propaganda have pinpointed this year's milestone Korean War anniversary as a prime time to play up Kim's military credibility as well as to push for a peace treaty. By creating the impression that a U.S. attack is imminent, the regime can foster a sense of national unity and encourage the people to rally around their new leader.

    Inside Pyongyang, much of the military rhetoric feels like theatrics. It's not unusual to see people toting rifles in North Korea, where soldiers and checkpoints are a fixture in the heavily militarized society. But more often than not in downtown Pyongyang, the rifle stashed in a rucksack is a prop and the "soldier" is a dancer, one of the many performers rehearsing for a Korean War-themed extravaganza set to debut later this year.

    More than 100,000 soldiers, students and ordinary workers were summoned Friday to Kim Il Sung Square in downtown Pyongyang to pump their fists in support of North Korea's commander in chief. But elsewhere, it was business as usual at restaurants and shops, and farms and factories, where the workers have heard it all before.

    "Tensions rise almost every year around the time the U.S.-South Korean drills take place, but as soon as those drills end, things go back to normal and people put those tensions behind them quite quickly," said Sung Hyun-sang, the South Korean president of a clothing maker operating in the North Korean border town of Kaesong. "I think and hope that this time won't be different."

    And in a telling sign that even the North Koreans don't expect war, the national airline, Air Koryo, is adding flights to its spring lineup and preparing to host the scores of tourists they expect to flock to Pyongyang despite the threats issuing forth from the Supreme Command.

    War or no war, it seems Pyongyang remains open for business.

    Deal for Martin to replace Hamlin blows up

    CHARLOTTE, N.C. (AP) ? A deal to loan Mark Martin to Joe Gibbs Racing as a replacement driver for injured Denny Hamlin fell apart Friday, when Michael Waltrip Racing said Martin will fulfill his commitment to its team.

    When the dust settled for both teams, Brian Vickers wound up as Hamlin's replacement driver for at least four races. He was already scheduled to drive Martin's car for MWR at Martinsville next week and will keep that commitment, with Martin driving Hamlin's car.

    Then Martin will go back to MWR, and Vickers will drive Hamlin's car until he's medically cleared to return from a fractured vertebra in his lower back.

    The about-face came down from MWR roughly 24 hours after JGR said Martin will take over the No. 11 Toyota until Hamlin returns. He's out at least five races.

    "We were a bit premature in determining Mark's status past Martinsville," J.D. Gibbs, president of Joe Gibbs Racing, said in a Friday night statement.

    MWR said Martin will return to his regular car after Martinsville and "resume his previously scheduled run of events with MWR" for the rest of the season.

    "I think it is great that a driver of Mark's caliber is available to support our fellow Toyota team during this difficult time for them. We wish Denny a speedy recovery" said MWR founder and co-owner Michael Waltrip. "Mark is a big part of our organization and is committed to our sponsors, especially Aaron's and Toyota. We have a lot of goals yet to reach this year and we are very focused on accomplishing them."

    It's believed a deal between the teams to swap Martin for Vickers in the Sprint Cup Series races had been completed, but JGR prematurely announced it before MWR sponsor Aaron's had given its approval. No reason has been given why Aaron's didn't approve the swap.

    MWR has been eyeing Vickers as a potential replacement for Martin in the No. 55 Toyota, and Vickers is scheduled to run nine races for Martin this year. Because Vickers is seen as an option for that ride, MWR was in favor of loaning Martin to the Gibbs camp to get an extended look at Vickers in its equipment.

    Instead, JGR turned to a Plan B, which is Vickers, a day after Gibbs said the team wanted to use just one driver for consistency sake.

    Vickers had the commitment to MWR for the first race, and Elliott Sadler, the second driver in JGR's Nationwide Series camp, already has commitments to drive the Cup races at Kansas and Talladega in a fourth car for JGR.

    "Obviously, having to find someone to fill in for Denny is not an ideal situation to have to be in, and when you start a process like this you obviously begin to look at the drivers that are not only available but also able to drive for your race team and manufacturer," Gibbs said. "We're real happy to have the opportunity to get Brian in our Cup cars and with him driving Nationwide for us we think we have some continuity there that is beneficial.

    "We really appreciate everyone at Michael Waltrip Racing and Toyota for working with us through this process. The good thing for us is that we have drivers the caliber of Mark and Brian to help fill in until Denny comes back."

    Researchers find novel way plants pass traits to next generation

    New research explains how certain traits can pass down from one generation to the next ? at least in plants ? without following the accepted rules of genetics.

    Scientists have shown that an enzyme in corn responsible for reading information from DNA can prompt unexpected changes in gene activity ? an example of epigenetics.

    Epigenetics refers to modifications in the genome that don't directly affect DNA sequences. Though some evidence has suggested that epigenetic changes can bypass DNA's influence to carry on from one generation to the next, this is the first study to show that this epigenetic heritability can be subject to selective breeding.

    Researchers bred 10 generations of corn and found that one particular gene's activity persisted from one generation to the next whether the enzyme was functioning or not ? meaning typical genetic behavior was not required for the gene's trait to come through.

    And that, the scientists determined, was because the enzyme targets a tiny piece of DNA ? previously thought of as "junk DNA" ? that had jumped from one area of the genome to another, giving that little fragment power to unexpectedly turn on the gene.

    The gene in question affects pigmentation in the corn plant. As a result of these experiments, the researchers were able to change yellow kernel corn to a blue kernel variety by compromising the activity of the enzyme in each male parent.

    "This is the first example where somebody has been able to take an epigenetic source of variation and, through selective breeding, move it from an inactive state to an active state," said Jay Hollick, associate professor of molecular genetics at The Ohio State University and lead author of the study. "The gene changes its expression in an epigenetic fashion and it doesn't follow standard inheritance behaviors. Those two factors alone have pretty profound implications not only for breeding but also for evolution."

    The study appears online in the journal The Plant Cell.

    Plant breeders tend to expect to generate desired traits according to what is known as Mendelian principles of inheritance: Offspring receive one copy of genes from each parental plant, and the characteristics of the alleles, or alternative forms of genes, help predict which traits will show up in the next plant generation.

    However, epigenetic variations that change the predictability of gene behavior have complicated those expectations.

    "The breeding community searches for novel traits that will have commercial interest and they really don't care what the basis is as long as they can capture it and breed it. Epigenetic heritability throws a kink in the expectations, but our findings also provide an opportunity ? if they recognize the variation they're looking for is the result of epigenetics, they could use that to their advantage," said Hollick, also an investigator in Ohio State's centers for RNA Biology and Applied Plant Sciences.

    "Just by knowing that this allele behaves in this epigenetic fashion, I can breed plants that either have full coloration or no coloration or anything in between, because I am manipulating epigenetic variation and not genetic variation. And color, of course, is only one trait that could be affected."

    With a longtime specialization in the molecular basis for unexpected gene activity in plants, Hollick had zeroed in on an enzyme called RNA polymerase IV (Pol IV). Multiple types of RNA polymerases are responsible for setting gene expression in motion in all cells, and Pol IV is an enigmatic RNA polymerase that is known in plants to produce small RNA molecules.

    Pol IV has puzzled scientists because despite its strong conservation in all plants, it appears to have no discernible impact on the development of Arabidopsis, a common model organism in plant biology. For example, when it is deleted from these plants, they show no signs of distress.

    In corn, however, Hollick's lab had discovered previously that the absence of Pol IV creates clear problems in the plants, such as growing seeds in the tassel.

    Hollick and colleagues observed that plants deficient in Pol IV also showed pigmentation in kernels of ears expected not to make any color at all ? meaning they were expected to be yellow.

    "Since we knew the misplaced tassel-seed trait was due to misexpression of a gene, we hypothesized that this pigment trait might be due to a pigment regulator being expressed in a tissue where it normally is never expressed. Molecular analysis showed that that was in fact the case," Hollick said.

    The researchers selected dark kernels and light kernels from multiple generations of plants and crossed the plants derived form these different kernel classes to create additional new generations of corn.

    "We found that the ears developed from those plants had even more darkly colored kernels and fewer lightly colored kernels. We could segregate the extreme types and cross them together and get this continued intensification of the pigmentation over many generations," he said. "We generated more progeny that had increasing amounts of pigment. This is taking a gene that is genetically null, that doesn't have any function in this part of the plant, and turning it from a complete null to a completely dominant form that produces full coloration.

    "Essentially we were breeding a novel trait, but not by selecting for any particular gene. We were just continually altering the epigenetic status of one of the two parental genomes every time."

    This led the scientists to question why the affected alleles of the pigmentation gene would behave in this way. An investigation of the affected alleles revealed the nearby presence of a transposon, or transposable element: a tiny piece of DNA that has leapt from one area of the genome to another.

    Because the sequence of some small RNA fragments that come from Pol IV's activity are identical to the sequence of these transposons, the finding made sense to the scientists.

    "Now that we know that Pol IV is involved in regulating transposons, it's not surprising that genes that are near transposons are now regulated by Pol IV," Hollick said.

    Lawsuit against Yankees GM Cashman is dropped

    NEW YORK (AP) - The mother of a woman accused of stalking New York Yankees General Manager Brian Cashman has abruptly dropped her lawsuit against him.

    The New York Post (http://bit.ly/11RiVwB ) reports that Caroline Meanwell filed documents in court Tuesday to drop the lawsuit.

    The suit had alleged that Cashman conspired with her daughter's former therapist and his legal team to trick Meanwell into calling 911 to discredit her daughter, who had claimed to have a nine-month affair with Cashman.

    The suit claimed Meanwell was coerced into telling authorities her daughter, Louise Neathway, was going to kill herself so Neathway would be institutionalized.

    Prosecutors say Neathway stalked Cashman and got him to pay her $6,000 by threatening to damage his reputation.

    Neathway has pleaded not guilty.

    Authorities: Neighbor claims battery by Bieber

    CALABASAS, Calif. (AP) ? Deputies were investigating claims made Tuesday by a neighbor that Justin Bieber attacked and threatened him during an argument in suburban Los Angeles, authorities said.

    No one was arrested and few details were immediately available.

    A representative of Bieber, Melissa Victor, did not immediately return a request for comment.

    Online schedules indicate the "Baby" singer is in the midst of a European tour and performed a show in Poland on Monday night.

    Authorities were called to the Calabasas scene just after 9 a.m., said Steve Whitmore, spokesman for the Los Angeles County Sheriff's Department.

    "There have been allegations made against Mr. Bieber of battery and making threats," Whitmore said.

    It's unclear who called authorities, and whether there might have been previous problems between the 19-year-old singer and neighbors, Whitmore said.

    In recent years, the Canadian singer has been constantly chased by paparazzi while publicly morphing from an almost angelic mop-topped teen to an adult battling a bad boy image.

    Recently, Bieber lashed out at paparazzi and lunged at one photographer as members of the singer's entourage held him back.

    Last summer, he got a speeding ticket while trying to avoid a bevy of photographers on a Los Angeles freeway in his distinctive chrome Fisker Karma.

    He collapsed backstage during a recent London concert and canceled a performance in Portugal.

    Prosecutors decided against filing charges after the pop star was accused of kicking and punching a photographer outside a Calabasas movie theater in May 2012.

    Earlier this year, an ex-bodyguard sued Bieber for alleged assault and more than $420,000 in unpaid wages. Moshe Benabou claims Bieber repeatedly punched him in the chest after an argument over the singer's entourage.

    Lately, the slim singer has taken to whipping off his shirt in public places.

    Saliva testing predicts aggression in boys

    Mar. 26, 2013 ? A new study indicates that a simple saliva test could be an effective tool in predicting violent behavior.

    The pilot study, led by Cincinnati Children's Hospital Medical Center and published this week online in the journal Psychiatric Quarterly, suggests a link between salivary concentrations of certain hormones and aggression.

    Researchers, led by Drew Barzman, MD, a child and adolescent forensic psychiatrist at Cincinnati Children's, collected saliva samples from 17 boys ages 7-9 admitted to the hospital for psychiatric care to identify which children were most likely to show aggression and violence. The samples, collected three times in one day shortly after admission, were tested for levels of three hormones: testosterone, dehydroepiandrosterone (DHEA) and cortisol. The severity and frequency of aggression correlated with the levels of these hormones.

    Barzman's team focused on rapid, real-time assessment of violence among child and adolescent inpatients, a common problem in psychiatric units. But he believes a fast and accurate saliva test could eventually have several other applications.

    "We believe salivary hormone testing has the potential to help doctors monitor which treatments are working best for their patients," said Barzman. "And because mental health professionals are far more likely to be assaulted on the job than the average worker, it could offer a quick way to anticipate violent behavior in child psychiatric units. Eventually, we hope this testing might also provide a tool to help improve safety in schools."

    For this study, the saliva test was used in combination with other aggressive behavior tools, including the Brief Rating of Aggression by Children and Adolescents (BRACHA) questionnaire, an assessment tool also developed by Barzman's team to predict aggression and violence in the hospital.

    "This study sample, while small, gives us the data we need to move forward," added Barzman. "We have more studies planned before we can reach a definitive conclusion, but developing a new tool to help us anticipate violent behavior is our ultimate goal."

    Barzman's team included Douglas Mossman, MD, a psychiatrist at the University of Cincinnati (UC) and an internationally recognized authority on violence prediction; Michael Sorter, MD, Director, Division of Psychiatry at Cincinnati Children's; David Klein, PhD, MD, an endocrinologist at Cincinnati Children's; Thomas Geracioti , MD, an expert in the endocrinology of mental disorders based at the Veterans Administration Medical Center and Kacey Appel, a PhD candidate in epidemiology at UC.

    Supreme court limits police use of drug-sniffing dogs

    (Reuters) - The Supreme Court on Tuesday limited the ability of police to use a trained dog to sniff around the outside of a home for illegal drugs that might be inside.

    By a 5-4 vote, the court said the use by law enforcement authorities of trained police dogs to investigate a home and its immediate surroundings was a "search" within the meaning of the Fourth Amendment of the Constitution, and required a warrant.

    "A police officer not armed with a warrant may approach a home and knock, precisely because that is no more than any private citizen might do," Justice Antonin Scalia wrote for the majority.

    "But introducing a trained police dog to explore the area around the home in hopes of discovering incriminating evidence is something else," he added. "There is no customary invitation to do that."

    For purposes of the Fourth Amendment, Scalia said, "the home is first among equals."

    The decision upheld a 2011 ruling by the Florida Supreme Court suppressing evidence uncovered at Joelis Jardines' home with the help of Franky, a chocolate Labrador retriever with a strong record of sniffing out drug stashes.

    Howard Blumberg, a public defender who argued Jardines' appeal, said he was pleased by the ruling. "It's a very important decision for all citizens, because it helps ensure their right of privacy in the places where they live," he said in a phone interview.

    Gregory Garre, a former U.S. solicitor general who argued Florida's appeal, did not immediately respond to a request for comment.

    TWO DOG SNIFF CASES

    Franky's handler, Detective Douglas Bartelt, had let the dog smell near the base of the front door of the home near Miami after receiving an anonymous tip about marijuana growing inside.

    Only after the dog sat down, signaling an "alert" that something was amiss, did the police obtain a warrant to search inside.

    The tip proved accurate and more than 25 pounds (11.3 kilograms) of marijuana were found inside, leading to Jardines' arrest.

    Blumberg said Jardines is now in a Florida state prison on unrelated charges, but that Tuesday's decision ends the case stemming from the dog's search.

    The decision is the court's second this term addressing whether law enforcement authorities complied with the Fourth Amendment in obtaining drug evidence based on a sniffer dog's "alert."

    On February 19, the court had unanimously allowed the search of a pickup truck, saying the handler of a dog that had signaled the presence of drug ingredients inside could reasonably believe that the dog was reliable.

    IDEOLOGICAL DIVIDE BREACHED

    Tuesday's vote did not follow the Supreme Court's usual ideological divide.

    Joining Scalia's opinion were Justice Clarence Thomas, who is one of the more conservative justices, and the more liberal Justices Ruth Bader Ginsburg, Sonia Sotomayor and Elena Kagan.

    In a concurring opinion, Kagan, joined by Ginsburg and Sotomayor, wrote that the search violated Jardines' reasonable expectation of privacy, an issue Scalia did not reach.

    The search dog Franky "was not your neighbor's pet," Kagan wrote.

    Justice Samuel Alito dissented, joined by Chief Justice John Roberts, Justice Anthony Kennedy and Justice Stephen Breyer.

    The latter is part of the court's more liberal wing, but sometimes votes more conservatively in criminal cases.

    Alito noted that law-enforcement authorities have employed dogs' acute sense of smell for centuries and the use of Franky was not a trespass and did not violate Jardines' privacy rights.

    "A reasonable person understands that odors emanating from a house may be detected from locations that are open to the public," Alito wrote. "A reasonable person will not count on the strength of those odors remaining within the range that, while detectible by a dog, cannot be smelled by a human."

    Scalia said using the dog was no different from using thermal imaging technology from afar to peer inside homes without a warrant, which the court voided in a 2001 decision he also wrote.

    "The antiquity of the tools that they bring along is irrelevant," Scalia wrote, referring to police.

    Scalia also wrote a 2012 decision that limited the police's use of GPS vehicle-tracking devices.

    The case is Florida v. Jardines, U.S. Supreme Court, No. 11-564.
